Terms of Service

Wezzlyvibe provides a community engine for Wix sites, including chat, posts, direct messages, gamification, challenges, events, AI-assisted engagement, analytics, and related embeds, dashboards, and APIs (collectively, the "Service").

The Service is provided on an "as is" and "as available" basis. Features, limits, pricing, and availability may change at any time without prior notice.

You must be at least 18 years old and able to form a binding contract. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, including activity by your team members and end users.

You must provide accurate information and keep it current. We may suspend or terminate accounts that contain false, misleading, or fraudulent information.

Paid plans renew automatically each billing period until cancelled. Fees are non-refundable except where required by law. Upgrades take effect immediately; downgrades take effect at the end of the current period.

You authorize us and our payment processors to charge your payment method for all applicable fees, taxes, and overage charges. Failure to pay may result in suspension or termination of the Service. We may change pricing with 30 days' notice.

You agree not to, and not to permit any user to:

• Violate any law, regulation, or third-party right.
• Post or transmit content that is illegal, harassing, defamatory, hateful, sexually explicit involving minors, or that infringes intellectual property.
• Send spam, run unauthorized advertising, scrape, reverse engineer, or attempt to gain unauthorized access to the Service.
• Probe, attack, or interfere with the integrity, performance, or security of the Service or related infrastructure.
• Use the Service to train competing AI models, build a competing product, or resell the Service except under an Agency plan.

We may remove content, throttle, suspend, or terminate accounts that violate these rules, with or without notice, at our sole discretion.

You retain ownership of content you and your end members submit ("Customer Content"). You grant Wezzlyvibe a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, reproduce, modify (for formatting), and create derivative works of Customer Content solely as needed to operate, secure, improve, and provide the Service.

You represent and warrant that you have all rights, consents, and permissions necessary to grant this license and that Customer Content does not violate any law or third-party right.

The Service includes AI-generated outputs. AI outputs may be inaccurate, incomplete, or offensive. You are solely responsible for reviewing outputs before relying on or publishing them. We do not guarantee that AI outputs are unique, non-infringing, or fit for any particular purpose.

You will not submit personal data, regulated data (e.g., health, financial, biometric) or other sensitive content to AI features unless permitted by your plan and applicable law.

The Service integrates with Wix and other third-party platforms. Your use of those platforms is governed by their own terms. We are not responsible for third-party services, their availability, or any loss caused by them.

Wezzlyvibe and its licensors own all rights, title, and interest in and to the Service, including all software, models, designs, trademarks, and documentation. No rights are granted other than the limited license to use the Service in accordance with these Terms.

Each party will protect the other's non-public information disclosed in connection with the Service using at least reasonable care, and will use it only to perform under these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WEZZLYVIBE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO WEZZLYVIBE FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

You will defend, indemnify, and hold harmless Wezzlyvibe and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) Customer Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

We may suspend or terminate the Service or your account at any time for any reason, including suspected abuse or non-payment. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive (e.g., IP, disclaimers, liability, indemnity, governing law) will survive termination.

We may modify these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and the parties consent to personal jurisdiction there. To the extent permitted by law, each party waives any right to a jury trial and to participate in class actions.
